Planning Commission denies short-term rental request at 114 River Road pending permits, orders

The City of Oregon Planning Commission on Aug. 20 denied a special-use request for a short-term rental at 114 River Road, ruling that outstanding permitting and safety issues must be resolved before a license will be granted.
During the public hearing, applicant Brian Wynn said the location is being operated as a short-term rental and that "their goal is to develop the property and eventually add a couple of cabins." Commissioners raised procedural and safety concerns: Roger Cain said the application "was filed late and building permits were not applied for when construction began on the property a year ago," and Liz Hiemstra said the listing remained live on Airbnb despite assurances it would be taken down and emphasized that "the permitting process is there for public safety."
City Manager Darin DeHaan told the commission the city has been "very diplomatic" while working with the applicant but that fines will be assessed for rental occurrences that took place without a license and required permits. DeHaan also reported that Building Inspector Casper Manheim has not issued an occupancy permit and that Police Chief Matt Kalnins has the authority to evacuate occupants until the property is brought into compliance.
Commissioner Liz Hiemstra moved to deny the special-use request "until an agreeable resolution is made including a cease-and-desist order," a motion seconded by Karly Spell and adopted with no nays. The commission also closed the public hearing at 5:58 p.m. and approved minutes for the July 16 meeting earlier in the session.
The City Manager said he will draft a resolution for the City Council to consider at its next meeting and that the police department will monitor the River Road property for occupancy and take action if necessary. The denial leaves the applicant required to pursue permits, an occupancy inspection, and to coordinate removal or deactivation of any rental listings before the commission will reconsider the request.
