SLA grants reconsideration to Cayuga Nation liquor application; board asks staff for data review

The State Liquor Authority on Aug. 6 granted reconsideration to a Cayuga Nation liquor-store application after counsel presented new affidavits and operational commitments. Michelle Behringer, identified on the record as the Cayuga Nation’s chief operating officer, told commissioners the Nation would operate the store under its federally approved alcohol ordinance, patrols by tribal police and on-site security during busy times. "They will only sell alcohol to individuals age 21 and older, and they will check IDs to confirm age requirements," Behringer said on the record.
Commissioners pressed for details about staffing, tax treatment and security technology; officials noted that New York’s approach to tribal retail sales can exempt certain transactions from state sales tax while distributors pay excise taxes. After a brief in-camera conference with counsel the board agreed to reconsider but said licensing staff should pull and review the authority’s historic sales and proximity data before voting on a final outcome at the Aug. 26 meeting.
