Legal counsel recommended the Board adopt a resolution to permit the district to engage contingent-fee counsel to investigate and, if appropriate, pursue claims related to building damage. Counsel explained that the Texas Attorney General's template for contingent-fee agreements must be used for expedited AG review. Trustees adopted the enabling resolution and approved contingent-fee agreements with O'Hanlon, Demerath & Castillo, P.C. and Flores & Pelaez-Prada, PLLC (dba Stormlex Law Group).
The Board voted unanimously to proceed. Counsel said the step enables the district to explore carrier claims or other recovery options that fall outside normal legal services arrangements.
