Complainant Dr. Benonado introduced photos and emails she says document campaign signs for David Montoya on public property in District 1, including utility poles at De Vargas Mall, bridges over the river near Saint Francis and Alameda, and rail-trail locations. Witness Catherine Rivera, a District 1 resident and former candidate, testified she sent dated emails to the city clerk on Nov. 25 and Dec. 2 with photographs and specific locations and said some signs remained after the election deadline.
Rivera described going to a vacant property on West Alameda where she found four Montoya signs she said the property owner had not authorized; she removed those signs and left them in a place for Montoya to collect. The complainant argued the photographs and emails show signs on public infrastructure that are not the sort of small yard signs that could easily have been stolen and reinstalled elsewhere. "The sign on the gate is located at the intersection of West Alameda and Via Veteranos," Rivera testified, describing dates and locations sent to the clerk.
