Residents press council over Stop 42 structure as State reviews case

The Village of Michiana heard sustained public concern about a structure at Stop 42 on May 9, 2025, with the council saying it would step aside while the State reviews the matter. Tim McCarthy moved to add an update on the Stop 42 structure to the agenda and told residents the Village was "stepping down at this time until we hear back from the State."
Residents questioned what to do next and the landowner, Caroline Rogers, told the council she applied for permits with EGLE and the Building Department and that she "was not trying to be defensive but she didn’t know she was doing anything wrong." Bill Schutt raised ownership concerns, noting the Village owns the roads in the area and that "a road still exists in that area where the structure was built," which may affect local enforcement or remediation options. Building Inspector Bill Lambert reported the structure had been permitted to a different address than where it was built, a discrepancy the council and residents flagged as material to any review.
Councilors declined to take further local action while the state agency reviews the site; when a resident asked whether individuals should contact EGLE, McCarthy said he "can not give direction on what individual residents do and it was up to them if they wanted to contact EGLE." The issue resurfaced during general public comment when Lynn and Joel Altschul expressed "extreme concern" about the beachfront structure, keeping the topic active for follow-up once the State completes its review.
