At the Jan. 27 public hearing several residents raised concerns that language referencing property "acquisition" could permit the City to take private land by eminent domain. Dan Koski asked directly whether the wording implied eminent domain, saying: "it mentioned private investment and also mentioning acquisition, but the way I read it sounds like eminent domain."
Moran Economic Development consultant Jake Zambaldi responded that the TIF statute "doesn’t provide any more tools for eminent domains than the municipality already has; it is not a tool that is designed to allow the City to take property forcefully." He added that if a developer sought to buy private property inside the TIF, those purchases would be negotiated between the property owner and the developer, and any City redevelopment agreement would be a separate negotiation. The hearing record shows no instance of the City asserting new condemnation powers tied directly to the TIF.
