Town says developer hasn’t met permit conditions; Parcel B conveyance paused

Supervisor Sterling told the board he received a letter from Front Street demanding conveyance of Parcel B, which would enable the developer to pursue permits for a proposed hotel. Sterling said town attorneys have reviewed the master agreement and advised that conveyance should not occur "prior to issuance of those permits and approvals" because the agreement requires transfer only after all necessary permits and approvals are in place.
Sterling said the town has found missing paperwork and potential easement issues that complicate conveyance. He described outreach to the APA and said he expects a written legal opinion from town attorneys soon; he will then notify the developer. Sterling also noted the long lapse in project activity (about 21 years) and suggested future agreements include timelines and performance penalties to avoid prolonged uncertainty.
