Board approves unpermitted addition but denies pool variance at Cottage Oaks property

The Zoning Board split its decision on a single application at 604 Cottage Oaks Circle on Nov. 10: it approved a variance for an unpermitted house addition but denied the requested pool setback variance.
Applicant Maria Rosepidis testified the addition already existed when she bought the house and that language and permitting confusion — and English-language difficulties — contributed to the construction being completed without a permit. On the addition, the board concluded extraordinary circumstances applied and approved the variance allowing the addition to remain 11.2 feet from the rear line where 15 feet is required.
However, the board voted down the pool request. Members questioned whether the pool could be moved and whether required inspections (electrical, plumbing) could be completed after-the-fact; the board determined the pool placement did not meet setback standards and denied that portion of the request. Staff instructed the applicant to work with county code enforcement to resolve outstanding inspection and permitting items.
