Applicant representatives said the lot has three street frontages and a drive‑through that creates practical difficulties in meeting the full 10‑foot foundation‑planting requirement for all building faces. Planning staff said the practical difficulties appeared self‑imposed by site design and recommended denial; however, staff suggested two conditions if the commission chose to approve: require a minimum 5‑foot foundation planting where eliminated and require submission of a revised landscape plan showing redistributed plantings across the site.
Applicant engineer Dustin Myers said the petitioner would accept a 5‑foot foundation planting in non‑drive‑through areas and clarified that planting would be placed adjacent to the parking area where space permits. With that clarification and the staff‑recommended landscape plan condition, the commission approved the waiver by roll call, 8–1.
The conditions appear on the record and the applicant must submit the revised landscape plan before final approvals proceed.
