Commission approves conditional use for accessory apartment in Derby-area pole barn

County planning staff presented a conditional-use request (CON2025-00081) to allow an accessory apartment inside an existing pole barn located at 8201 South Millsap Drive in the Derby area of influence. Scott Wadell reviewed the parcel context, the July 10 MAPC unanimous approval, and the Derby Planning Commission recommendation which included a waiver of the supplementary-use compatibility requirement. He said the applicant intends the accessory apartment for family and guest use, not as a rental.

Commissioners asked clarifying legal questions about voting thresholds tied to differing planning recommendations and then opened the public hearing for the item; no opponents spoke. Commissioner Howell moved to waive the compatibility appearance requirement and approve the conditional use subject to staff conditions; the board approved the motion by roll call. The commission also discussed moving toward more as-of-right allowances for accessory dwelling units in the future.
