ZBA approves 2-foot height variance for accessory workshop at 230 Chilho Drive

The Zoning Board of Appeals approved a height variance for an accessory workshop at 230 Chilho Drive after the applicant said the building was constructed from approved plans but later determined to exceed the 25-foot accessory-top limit by about 2 feet.

Staff said the primary home on the 5.25-acre lot is about 33 feet tall and that the accessory workshop stands at 27 feet. Applicant Steven Ryan told the board the plans were drawn by an architect, a permit was sought and approved, and that the height discrepancy was discovered during inspections: "We built it. It wasn't until a few months into it and a few inspections that it was brought to our attention that the 27 feet exceeded the 25 feet." He added the workshop sits lower than the main house.

Board members asked whether architectural features such as a cupola affected the ridge measurement; one member noted cupolas may be exempt from the height limit. After discussion, a motion to approve the variance carried 4-0.

Staff closed the item and reminded the applicant that the variance applies to the structure as built; follow-up inspections and permit-file updates will be completed by county staff.
