The board received a solicitors briefing on a small tract identified as Parcel 84 on Pine Road in Penn Township. The solicitor said the land appears to remain titled to the former Penn Township School District and therefore to Big Spring School District by operation of municipal consolidation.
"Parcel 84 is actually the parcel we're talking about," the solicitor said while describing the attached deeds and survey. He told the board the property appears vacant, roughly 0.25 acre in size (about 200 feet by 57 feet), and that, because district-owned property is tax-exempt, the administration should clarify whether taxes have been paid and stop paying them going forward if inappropriate.
On disposal options, the solicitor outlined three paths: an outright auction, accepting sealed bids, or a court-directed sale. He recommended accepting sealed bids as the least expensive and most administratively straightforward option and offered to prepare the paperwork. Board members asked about neighbors currently farming the land, whether adverse possession could apply (the solicitor explained government-owned property generally cannot be acquired by adverse possession), and liability coverage if the district retains ownership.
The board directed administration to prepare a motion and paperwork to post the property for disposition and to notify adjoining landowners; the matter will return for formal board action at a future meeting.
