Committee advances tougher rules and enforcement tools for home-based businesses

The PHED Committee recommended CB71-2026, a bill that revises the county's home-occupation and home-business rules to clarify prohibited behaviors, define "business use vehicle," provide presumptive evidence standards for enforcement, and raise penalties for repeated violations.

Sponsor commentary framed the bill as a coordinated effort with a companion enforcement bill in another committee and said the primary targets are contractor fleets operating out of residential properties and home-based auto repairs or sales that disrupt neighborhoods. "So this is our effort... to try to get after" vehicle fleets and auto-repair operations that impede emergency access and create parking problems, the sponsor said.

David Warner, Principal Counsel for Park and Planning, said the Planning Board generally understood the intent but cautioned that many of the provisions appear duplicative of existing county code and zoning-enforcement authorities and warned that restating prohibitions could create confusion. He recommended focusing on targeted, enforceable definitions (for example, the business-use-vehicle definition) rather than restating prohibitions already covered elsewhere in code.

After discussion and proposed technical adjustments, the committee moved to recommend draft 2 as amended; the roll call recorded a 4-0 favorable recommendation. The committee's recommendation sends the draft to the full council for the next steps.
