Alameda County advances draft ban on retail nitrous oxide sales to full Board

Alameda County Public Health staff recommended a local ordinance to prohibit retail sales of nitrous oxide and related devices in unincorporated county areas, citing increases in emergency visits and deaths tied to recreational misuse. Paul Cummings, director of the county Tobacco Control Program, told the committee the products are “a growing public health concern,” and that flavored, brightly packaged products often target young people.

The draft ordinance would prohibit retail sale of the products in unincorporated areas while preserving lawful medical, pharmaceutical, industrial and culinary uses. It would require retailers to maintain documentation, allow the Community Development Agency to inspect and seize products, and impose tiered fines ($2.50 first violation, then $500, then $1,000 for subsequent violations). Supervisor Tam moved to advance the draft to the full Board for consideration; the motion was seconded and the committee recorded affirmative votes to send the item forward. Staff said the ordinance will return to the Board after the recess for formal readings and potential adoption.
