Board hears update on Summit permit amendment and pending judicial decisions

Summit representatives told the board they filed an amendment to what they called Permit 1.0 (the county's permit) to add Denison's Anderson's plant to the project without changing route mileage in Iowa. Kylie Lang said railroads changed pipeline best practices and the company updated related practices across the system. She also said Summit upsized the pipeline segment into Nebraska to add optionality for sending CO2 to western sequestration sites and stressed that the amendment was chosen to preserve the historical administrative record rather than opening a new permit docket.

Steve Kinkle, the county pipeline liaison, briefed the board on outstanding legal steps and filings: he said there was an amendment to the permit, a remand for judicial review and a consolidation request from Summit; he told the board, "We do not expect anything before November 1, so I'm going to say between those November 1 and the 15th, we'll probably gonna get some direction." Kylie added that "The IUC only permits Iowa," noting other states have different permitting regimes. The board did not take regulatory action at the meeting but discussed next steps and requested continued updates as judicial activity progresses.
