Town documents seam failures on Hardman Road; contractor offers only localized patches

Administrator Aitken presented photographs and engineering observations showing failure points along Hardman Road, attributing the problem to an improperly executed seam where the chip seal met new paving and noting the contractor Avail did not saw-cut the seam. Aitken said the town had pressed Avail for comprehensive repairs but the contractor proposed isolated 2x2 or 4x4 cutout patches; Aitken reported the contractor’s representative called that approach "a Band-Aid to the Band-Aid." Administrator Aitken said he presented three possible town responses to Avail: ban the contractor from future projects, pursue legal action, or require Avail to repave at Avail's expense.

Town Engineer Ryan Welling will walk the road to further document failures and Town Attorney Kevin Voyles has been engaged. Aitken noted the warranty period expires in mid‑August, creating a near-term deadline for resolution. Council members discussed options but no formal motion or vote was recorded; staff recorded direction to document deficiencies and pursue appropriate remedies.
