Commissioners restrict conveyance-plat use, say it should not enable immediate development

Commission members clarified that the conveyance plat, as drafted, is intended as a tool to facilitate property conveyance and to document future easements — not to authorize immediate development.

"It's very clear to me reading this that this doesn't authorize anybody to do any development," the chair said during early discussion, and the point was reinforced by staff and commissioners who described conveyance plats as useful for subdividing large lots, documenting easements adjacent to existing infrastructure, and helping heirs or lot owners with conveyances.

Commissioner 4 and others flagged a sentence in the draft that would allow temporary permits (occupancy, utilities) in association with conveyance plats. The panel agreed that temporary building permits and temporary utility services are not appropriate when a conveyance plat explicitly is "conveyance plat only, not for development" and directed staff to strike the temporary-permit sentence.

Staff also noted that, while a conveyance plat can document planned easements and provide a framework to coordinate future infrastructure improvements, recent statewide plat-language changes limit municipalities' ability to force immediate dedication of easements. The commission asked staff to reconcile cross-references to the existing subdivision ordinance and to add clarifying language so the conveyance plat cannot be misused as a development-approval mechanism.
