Pratt County approves special-use permit for 20-acre battery storage site

Pratt County commissioners voted to adopt the planning board’s findings and approve a special-use permit for a 20-acre battery energy storage facility filed as case SU-2026-02 by Nennis Flats Energy Storage LLC. The board moved, seconded and approved the planning board recommendation and resolution 4-20-26; the chair noted that anyone aggrieved by the decision has 30 days after publication of the effectuating resolution to file an appeal in district court.

Zoning administrator BJ Harris summarized the application and the planning board’s recommendation: "case number SU 2026-2 applicant's name is Nennis Flats Energy Storage LLC. The request is for a battery storage facility." BJ described the site as the northwest corner of SE 20th Street and SE 80th Avenue in Pratt County, surrounded by A1 agricultural zoning with residences roughly within 1,000 feet. The planning-board report recommended approval with conditions, including coordination with the Pratt County Road Supervisor for any entrances or exits, continued coordination with the zoning department for additional special-use requests, and a requirement that the applicant update a decommissioning plan every five years to adjust for inflation.

Commissioners also reviewed follow-up documents staff said were being circulated — drafts of a decommissioning agreement, a road-use agreement and a contribution agreement — and discussed timing for finalizing those agreements before construction. The commission’s recorded action on the special-use permit is reflected in the meeting record; staff noted the appeal timeline and publication requirement for the effectuating resolution.
