De Mo County board moves forward on wind/solar/battery ordinance after acknowledging drafting error

De Mo County Board of Supervisors approved the second reading of a wind, solar and battery ordinance and waived a third reading during its Jan. 13 meeting after staff and counsel said a drafting error had been corrected in the posted document.

Land use staffer Jared Lasser told the board that a sentence in Article 12, section D of the December‑published draft contradicted earlier language by making restoration obligations apply to both participating and non‑participating properties. "That final sentence has been removed so that it only applies to the nonparticipating owners," Jared said, describing the change as a scrivener's error rather than an alteration of board intent. Board members then moved and recorded a roll‑call on a motion to approve the second reading and waive the third reading.

The action prompted extended public comment raising concerns that the removal was not adequately noticed. One commenter asked whether the internal discussions that led to the change had been held publicly. Attorney/trust counsel explained the corrected version had been posted before the hearing and counsel advised the board it could proceed under the applicable statutory reading rules. The clerk recorded votes in the meeting transcript; the roll call in the record shows at least one recorded 'No' vote. The minutes and the posted ordinance will reflect the final text filed for adoption.
