BZA approves variance for home at 0 Skyline Drive in Enon

The Village of Enon Board of Zoning Appeals approved a variance for property recorded as 0 Skyline Drive, permitting construction of a house that does not meet the R2 district’s 1,300-square-foot minimum. The motion to approve passed unanimously on a voice vote recorded as: Mr. Peril — yes; Mr. Alexander — yes; Mrs. Pettit — yes; Mr. Beard — yes.

Board staff introduced BZA Case 2025-01 and told the panel the owner is Lori Muny and that required public notices were issued. During the hearing, staff reported that Clark County Combined Health District issued a site approval for the septic system. Builder Timothy Whisker told the board the health department approved sanitation for a two-bedroom home and described the proposed ranch-style, two-car garage design. “The health department has approved it,” Whisker said when asked about the septic approval.

Neighbors raised concerns about subsurface limestone and localized flooding that could complicate tank installation and leach-field work. Harold Wilson, a neighbor, told the board he had watched crews drill through limestone nearby and warned, “I hope and pray you don't plan on they don't plan on doing any dynamiting.” Staff and the builder acknowledged the site conditions but said imported soil would be used for the leach field and that the tank installation is doable.

Mr. Alexander moved to approve the variance, arguing that, given surrounding house sizes, the proposal would not substantially harm neighborhood character; Mrs. Pettit seconded. The board directed none of the conditions constituting denial and approved the variance as presented. The chair reminded the public that a notice of intent to appeal must be filed within five days and a formal appeal application within 15 days.
