Codorus supervisors rule property with 1944 deed has dwelling right in 2-1 vote

The Codorus Township Board of Supervisors on July 3 recognized a dwelling right for property owned by Anna Thoman, parcel CG0099B, after board members reviewed a deed recorded in January 1944. Supervisor Lamar Glatfelter moved to grant the dwelling right; Bob Gladfelter seconded the motion and the board approved it on a 2–1 vote, with Charlie VanScoyoc voting no.

Board members cited the fact that the deed was recorded before the township's December 7, 1974 ordinance as the dispositive legal fact for the determination. The minutes state that "there was a deed located for that property that was recorded in January 1944," and that, following the vote, "a letter will be prepared and signed after the meeting stating that there is a dwelling right on the property." The board instructed staff to prepare written confirmation of the decision.

Why it matters: recognizing a dwelling right changes what development or building rights the owner can exercise on that parcel under the township's interpretation of the 1974 ordinance. The town will formalize the finding in a letter to be issued after the meeting, which can affect future permits or planning decisions affecting the parcel.
