Cope II replat public hearing ends with motion failing 2–2 after executive session

County staff presented a proposal to replat Lot 24 of the Cope II Addition to create a secondary emergency access easement and to install a gated access that would remain closed for general traffic but accessible for emergency vehicles.

Tracy Homfeld, an engineer, told the court the replat was checked for compliance with Texas Local Government Code Section 232.009 and that a gate would discourage through traffic while satisfying updated fire‑code requirements for a second point of access. Kyle, representing 1st Step Homes (P12), said the developer met with a concerned neighbor and agreed to the gate proposal to reduce traffic impact. Attorney Leonard Smith advised the court that under §232.009 staff review made approval ministerial — the statute contains a "shall approve" standard — and noted opponents could seek remedies later in court.

After public comment and staff presentations the court held the item for legal advice in executive session. On returning to open session, the motion to approve failed on a 2–2 vote and no further motions were offered; the replat remains unresolved.
