PLDRC approves pool variance for Amelia Drive property over staff objection, 4–3

Volusia County commissioners narrowly approved variances to allow an inground pool and decking on an atypical waterfront lot on Amelia Drive, despite staff—s recommendation to deny the pool placement under the 2021 accessory-structure rules. Applicant Sandra Massie and her contractor described site constraints (seawall, decks, lack of rear doors) and said the pool would sit largely beneath existing decking; the applicant—s attorney said the project "does not have any additional impact on the setbacks themselves because that deck is already there."

Commissioners debated whether the updated accessory rules were intended to eliminate pools on atypical waterfront lots versus address environmental conflicts. Member Craig and others voiced concerns, but after discussion four commissioners voted to approve the variances and three voted no. The approval is conditional on the staff recommendations and does not eliminate required environmental or building permitting steps; the applicant must still secure building permits and satisfy Indian River Lagoon standards during the permit review process.
