Council asks staff to seek code changes after zoning commission flags missing exhibit in Villas PUD

Council discussed next steps for the Villas planned-unit development (PUD) after a recent zoning-commission hearing on a request at 10:30 Sunflower Trail. The zoning commission recommended denial of the applicant’s request and suggested the council initiate a neighborhoodwide review; the application was withdrawn before council action.

Jerry Rusttoven, the city’s development services manager, said staff has been unable to locate "Exhibit A," the development plan referenced in the Villas PUD ordinance, and that the missing pages appear to be lot-specific sheets. "If we cannot locate it, [we will] try to recreate it," he said and recommended staff pursue a resolution to initiate a code amendment and outreach to Villas residents. Rusttoven also identified that restricted covenants were not filed as intended with all sales and that the current code provides limited clarity on what constitutes a major versus a minor PUD change.

Council and staff discussed options including numeric thresholds for impervious-cover changes, treating some impervious adjustments as administrative variances instead of full zoning cases, and the potential consequences of a "bucket" approach that pools impervious capacity across the PUD. Staff cautioned that adopting a bucket could reallocate development capacity and would be complicated to implement. Council asked staff to return with short-term items to fix missing documentation and with proposals for clearer code language as part of the broader land-development-code rewrite.
