Gustavsen asks Paramus commission to reconsider tree decision; panel votes not to reopen

At its April 8 meeting, the Board of Shade Tree & Parks Commission declined a resident's request to reopen a prior tree decision. Resident Gustavsen of 228 Monroe Avenue read a proposal from a tree company asking the commission to revisit the earlier determination. Borough Attorney Geoffrey Mueller and Chair W.R. Comery questioned whether a contractor's sales representative could authoritatively assess a tree's condition.

"You are always welcome to come and the commission is happy to listen, but there is no guarantee to re-open this issue," W.R. Comery told Gustavsen after commissioners debated options. B. Goggin moved "to not re-open for discussion," seconded by V. Piccinich; the motion carried with "All in favor." Commissioners said partial branch removal by a contractor could leave a hazard and expose the borough to liability, and that previously discussed options had already been voted on.

The panel did not set a future re-hearing date. Commissioners encouraged the resident to return with additional information but emphasized the commission's priority on public safety and its limited ability to accept a contractor's unilateral pruning plan.
