Selectboard moves forward on Hill Road culvert contract while flagging insurance and bond language

Town staff reported that contractor Sam Bourne is working to adjust his insurance coverage to meet VLCT requirements ($2 million per occurrence and $4 million aggregate) and to address landowner requests to be added to the policy. The Selectboard noted the VLCT contract for large projects requires a performance/completion bond that was not included in the RFP; staff are researching the potential cost of the bond. The board voted to proceed with the contract but to amend the clause to include language that "the contractor will pursue this coverage in good faith, and the Town will opt to elect the coverage and fund it" if necessary.

Selectboard Chair Mike DeSocio said FEMA requested current and planned guardrail dimensions; he will forward FEMA’s email to staff and the contractor so the town can respond and FEMA can move forward with its sign-off. Members emphasized the need to get the work started promptly while clarifying insurance and bond responsibilities.

Why it matters: the Hill Road culvert is a large FEMA-related repair; insurance and bonding affect contractor accountability and the town’s financial exposure. The board’s amended approach aims to allow work to begin while capturing protections if the contractor cannot secure required coverage.
