Emmet County adopts one-year moratorium on new data‑center permits

The Emmet County Board of Supervisors adopted Resolution 26‑25 on Aug. 25, 2026, establishing a temporary moratorium on county staff accepting, processing or approving applications for rezoning, subdivision or zoning permits for data centers in unincorporated Emmet County. The motion was made by Jeff Quastad and seconded by John Pluth; a roll call vote recorded five ayes.

The resolution says data centers “have the potential to create an excessive burden on energy and water resources,” and directs county staff to review zoning provisions, propose updated definitions and standards, present draft recommendations to the Planning & Zoning Commission and consult the county attorney about legal implications. The moratorium is written to last one year from the date of adoption unless the board acts to extend or terminate it sooner and exempts existing lawful facilities and permits that had final approvals before the moratorium’s effective date.

The resolution defines “data center” broadly to include enterprise, colocation and hyperscale facilities and related high‑density server operations. The board reserved the right to end the moratorium earlier if ordinance amendments and issues are satisfactorily resolved.
