Avon panel approves Misty I’s parking expansion; use variance and 50-animal limit remain

The Advisory Planning Commission approved DPR 26-11, authorizing Misty I's animal center to pave and expand an existing gravel parking lot on a 3.1-acre parcel zoned R‑2. Staff told commissioners the site’s commercial animal-center use was previously allowed through a use variance granted in 2015 and that prior development approvals (2018 DPR and a later modification) constrain the scope of permitted activity. Staff recommended approval because the revised plan is generally consistent with the original DPR and development standards.

Dale Cruz of Cruz Consulting, the petitioner’s engineer, told the commission the original layout assumed parking on both sides of a drive aisle but the site does not have room for that configuration. "So we only have parking spaces on 1 side of the drive aisle, which means we only get 0.5 the number of parking spaces along the east west portion of the of the parking lot, which means we added this to the west end of the building to get to get our parking spaces to comply with the development standards," Cruz said. Staff and commissioners noted paving the lot is an improvement over gravel and emphasized that the existing use variance and conditions (including a limit of no more than 50 cats and 50 dogs on site) remain in force.

A motion to approve DPR 26-11 passed on a roll-call style vote; the approval is subject to the conditions listed in the staff report and the findings of fact required under state law.
