Staff urges violations cleared, inspections and agreements before LAP Recycling rezoning

Planning staff told the commission there are open zoning violations at LAP-related properties that date to late 2023 and advised the board to require remediation as a precondition for rezoning. Staff recommended such conditions as payment or rectification of outstanding violations, drainage-board approval for site work, a road-use agreement to address truck impacts and periodic inspections to verify compliance.

The applicant’s engineer and company representatives said some state violations had been resolved through certified communications and that equipment-specific permits could follow a land-use approval. The company offered a timeline to consolidate operations to the proposed parcel and proposed an 18–24 month window to cease noncompliant activity at the existing site if rezoning were approved. Staff said it would draft specific conditions to circulate to the board and the applicant before the reconvened hearing, including suggested escrow or reimbursement agreements if the board finds them necessary.
