ZBA classifies 33 Lundy Lane project as SEQR Type II; discusses permeable driveway to avoid lot-coverage variance

The Zoning Board heard an area-variance application from property owner Dave LaCerais, represented by engineer Dave Kimmer of ABD Engineers, seeking relief from the 15% maximum lot-coverage limit because inclusion of the driveway footprint pushed the property’s impervious coverage to about 23%.

Mr. Kimmer explained the proposed driveway largely follows the existing footprint but would be enlarged to permit a safe turnaround; he estimated the additional area at roughly 1,000 square feet. Board members explored alternatives, including permeable driveway materials, to lower measured lot coverage. Board member Justin Zampella noted using permeable material can sometimes avoid a variance; the applicants said permeable surfaces are feasible but more expensive and harder to maintain.

The board voted to classify the project as a SEQR Type II action, exempting it from further environmental review, and scheduled a public hearing for April 1, 2026 at 6:31 p.m. Mr. Whitton observed that shifting to a permeable driveway could allow the project to proceed without variance relief, but he and other members acknowledged the cost and maintenance tradeoffs the applicants cited.
