Commission debates septic, private sewer systems and liability protections

The meeting included extended discussion of on‑site septic systems, private engineered treatment systems and public-health oversight. Commissioners and the county’s health-department representative (S18) said state and public-service regulators control percolation standards and that engineered systems can be permitted if they include engineered designs and demonstrated long-term maintenance plans.

Several participants urged the county to require guarantees that avoid future costs to taxpayers when private systems fail, including cash bonds, HOA maintenance obligations or private utility ownership. The chair described cash bonds as a preferred mechanism in some municipalities because cash is easier to enforce than surety bonds when developers leave or fail. “We would go to a cash bond, which means you've got a line of credit somewhere that covers... finishing the road to the when the subdivision is finished,” the chair said. Health department staff explained replacement-area and engineering-certification requirements for septic approvals and noted that engineered systems may require review by other state agencies.
