CLRC accepts crimes‑against‑persons review; only a few changes recommended and select sections tabled

The CLRC's subcommission on crimes against persons reported Jan. 29 that it reviewed chapter 30 (family violence), chapter 49 (bribery) and chapter 64 (gambling). The subcommission recommended no broad changes to most sections but proposed removing the phrase "unusual circumstances" from 30.20(d) to avoid redundancy with the established "manifest interest of justice" standard.

Attorney Joseph B. McDonald described the review and noted the subcommission found the family‑violence framework generally working: "We didn't see any of these sections that needed any amendments or repeals," he said. The group tabled specific provisions—identified in the meeting as section 49.90 and 64.40—for further analysis, and members discussed whether some forms of public‑official misconduct warrant felony‑level penalties when aggravating factors (high-level officials, large monetary benefit, repeat offenders) are present. After a motion and second, the commission accepted the subcommission's reviews with the tabled items retained for future study.
