Commission resolves multiple UI appeals on docket 35, reversing and resubmitting several cases

The commission conducted case-by-case deliberations on a batch of unemployment-insurance appeals pulled from UI docket 35 and issued a mix of procedural resubmissions, reversals, and affirmations. Several matters turned on timeliness, whether claimants had good cause for missing hearings, and whether separations were voluntary or involved misconduct. Commissioners repeatedly recorded short-form dissents where members disagreed with the majority.

On case No. 3825197, commissioners found that the claimant’s late arrival at the hearing (four minutes) warranted a good-cause finding and resubmission for merits testimony. For case No. 3867490 (a teacher who resigned after maternity leave), the majority voted to reverse the AT and not bill the employer, while case No. 3868401 (alleged failure to attend a mandatory meeting) culminated in an affirmation of the AT finding no misconduct after commissioners weighed employer evidence and prior warnings. In case No. 3873027, the commission reversed the AT after finding employer testimony insufficient to show misconduct and accepted the claimant’s account of a medically verifiable illness.

"Since the claimant made a good faith effort to participate in the hearing and was prevented from doing so by circumstances beyond his control, the claimant established good cause for his failure to appear...and the case should be resubmitted," one commissioner said while arguing for resubmission in case No. 3825197. The commission then moved to accept staff recommendations on the remaining UI cases on docket 35, noting exceptions recorded on a short-form dissent list.
