Commission tables billboard resolution after attorney says draft relies on amended code

Commissioners tabled Resolution 2026‑13, a decision about a billboard/sign for Troy Linton, after counsel for the applicant raised legal objections to the draft findings. Amanda Todd, identified in the meeting as the applicant's attorney, told commissioners the proposed findings rely on a definition that was not in the historical code and therefore "it is not legal to attempt to retroactively apply an amended code." The commission agreed to refer Todd's written objections to the city attorney and to table the resolution pending legal advice.

Todd also objected that the resolution's findings were conclusory about whether the sign fits permitted categories and said the draft inappropriately invoked federal advertising law rather than focusing on Mona Municipal Code. Commissioners said they would consult the city attorney and, if necessary, hold a special meeting to resolve the legal questions. "On that basis ... I object to the adoption of this resolution as it's currently drafted," Todd said on behalf of her client.
