Fairfield draft CUP would lengthen permit timeframes, drop automatic five-year check

A key feature of the draft conditional use permit ordinance presented Sept. 2 would change several timing rules that govern when an approved conditional use is established, when an inactive use is considered abandoned, and how often compliance is reviewed. The draft would extend the period to establish an approved conditional use from 180 days to 12 months and extend abandonment from six months to 12 months.

Planners and commissioners discussed removing an automatic five-year re-evaluation requirement. Planner Jim Spung said existing CUPs would remain subject to their original conditions, and that the Town could require periodic review as a condition on future permits when justified. Commissioners suggested that annual business-license review could provide a practical opportunity to verify ongoing compliance rather than an automatic five-year check.

Those timing changes affect applicants' project scheduling and could lengthen the period in which applicants must realize their approved plans before the permit expires or is deemed abandoned.
