Planning commission approves narrower paving requirement for Tacker truck yard in Sutter County

The Sutter County Planning Commission approved a use-permit amendment for project 17-007 (Tacker) that modifies Condition of Approval No. 6, narrowing the area required to be paved for truck-driver and employee parking.

Casey Murray, senior planner, told the commission the original 2018 approval allowed a large agricultural truck yard with up to 29 trucks and required paving the parking area by Oct. 31, 2020. Murray said the applicant earlier sought multiple extensions and that paving had been estimated at about $170,000. "So staff is recommending that the planning commission approve the use permit amendment to modify condition of approval number 6 based on the findings as listed in the staff report," Murray said. He added that recent site photos attached to the staff report "show that this paving has already been completed." Murray also noted staff had contacted local responders who reported no dust complaints from neighboring properties and that county zoning requires an "all-weather" surface—minimum 4 inches of Class 2 aggregate base or base rock—unless a paving requirement is imposed as a discretionary condition.

The chair opened public testimony and solicited speakers in favor and opposed; none came forward. A motion to approve the amendment was made and seconded. On a roll call the commission recorded 'aye' votes from Commissioners Schmittel, Emanuel, Marler, Dila and Campbell; the motion carried. The staff report lists the applicant as Harmon Tacker and the owner as Gavi HR LLC, and identifies the site as 5286 Highway 20, Yuba City (Assessor's Parcel No. 13-280-166).
