The Utah Court of Appeals heard oral argument over whether a Labor Commission-approved settlement that capped a claimant’s future medical payments via a structured annuity should be enforced, rescinded or otherwise interpreted. Counsel disputed how an annual annuity payment was to be administered and whether the Labor Commission had authority to require a party to sign a separate custodial/assignment agreement after approval.
