On Sept. 25, 2025, the President issued Executive Order 14352, finding that a proposed divestiture of TikTokand related applications would qualify as a 2qualified divestiture2 under the Protecting Americans from Foreign Adversary Controlled Applications Act (Public Law 118-50). The order pauses Department of Justice enforcement of the Act for 120 days, requires the Attorney General to provide guidance and letters to providers, and designates the Attorney General as the U.S. Government representative under the Framework Agreement. The order sets conditions intended to prevent operational relationships with ByteDance Ltd., requires U.S. storage of sensitive U.S. user data, and amends and revokes prior presidential actions related to TikTok.
