The Washington Supreme Court heard oral argument on Sept. 26, 2024, in Tracy Hall v. Walgreens Boots Alliance over whether Walgreens’ prominent “non drowsy” label is exempt from the Consumer Protection Act’s reach because the Food and Drug Administration has regulated drowsiness labeling. Counsel for Walgreens argued the FDA’s monograph governs the topic; the plaintiff urged the court the FDA did not specifically permit affirmative “non drowsy” claims and the safe-harbor exemption therefore should not apply.
