Court reconvened in a temporary Tumwater facility and the clerk/presiding justice announced the panel (Justice Madsen recused; Justice Pro Tem Catherine Loring sitting; Justices Whitener and Montoya Lewis joined remotely) and identified the case as Michael Wall (petitioner) v. On June 25, 2024 the Washington Supreme Court heard oral argument in Wall v. Grover in Tumwater on whether to recognize a doctrine of "constructive filing" to save a case where counsel says an e‑filing (complaint) was submitted within the statute of limitations but was not acknowledged by the clerk until later. The court heard competing views about the record evidence, the role of e‑filing acknowledgments, and whether Washington law already requires receipt within court hours.
