County staff: state review found TDR code legally deficient; revision required

Community Development Services staff told commissioners that the Washington State Department of Commerce found the county's Transfer of Development Rights code did not meet legal standards, prompting the requested moratorium extension to allow a comprehensive review and corrective revisions.

Chad Bala, Community Development Services director, introduced the staff report and asked Long Range Planner Jeremy Johnston to explain the need for the moratorium extension. Johnston said the Department of Commerce had determined the current TDR code language did not meet applicable legal standards and that staff needed time to prepare compliant revisions.
