Levy Court re-approves ProCut Tree Services conditional use plan

Kent County Levy Court on Sept. 15 granted conditional approval to ProCut Tree Services for a landscaping and horticultural operation at 1818 North Little Creek Road after a short public hearing and testimony from the applicant.

Planning staff said the application is a conditional-use site plan that previously had been approved but failed to meet the deadline for final-plan approval. Consultant Colby Kotchka, one of the project designers, testified the project complies with conditions and will benefit the public by allowing the operator to move forward. County attorney William Darby, who also spoke, told the court the project experienced delays with DelDOT and had been pending since the COVID period.

Commissioners confirmed that the Regional Planning Commission had unanimously recommended conditional approval, including three requested waivers. Commissioner Angel moved to grant conditional approval “based on exhibit A RPC recommendation report dated 09/15/2026” and hearing testimony; the motion passed by roll call (7 yays, 1 absent). The acting president stated the approval carries the previous conditions on the record.

The decision allows the applicant to proceed toward final plan approval subject to the conditions and required agency sign-offs noted in the staff and RPC reports. No members of the public spoke in opposition during the hearing.
