Commissioner: state land-use rules require township to provide for data centers

Commissioner Dennis Condusta told the board that Pennsylvania land-use law recognizes data centers as a legal commercial use and that municipalities must permit every state-recognized land use somewhere within their borders; the board said the overlay responds to that legal reality.

During discussion of the proposed energy and technology overlay, Commissioner Dennis Condusta said the action responds to state land-use law rather than originating as a local preference. "...according to Pennsylvania land use law, our state recognizes Data Centers as a legal commercial land use. In turn, that requires municipalities to permit for every State recognized land use somewhere within its borders," Condusta said.
