Glencoe draft code would consolidate indemnification language; staff clarifies limits

A staff member explained that the consolidated language is broad in scope for civil claims arising from acts, errors or omissions within the scope of village office or authorized service, but that Illinois law prevents indemnifying punitive damages. The staff member said the draft will be revised to make clear the village board must approve settlements or reimbursement of costs, but that indemnification itself should be automatic for covered actions and not require board approval.

Trustees asked whether state law would provide coverage even without the fix; staff said the revision is clarifying and that the code will specify limits (no reimbursement for criminal actions, no coverage for frolic-and-detour conduct). The board did not adopt the language at this meeting and asked staff to correct the drafting issue before presenting a final ordinance.
