Planning Commission approves oversized accessory structure with 25‑ft height limit after neighbor objection

Sep 9, 2026

After a neighbor spoke against a proposed 3,000 sq ft, 26.8 ft accessory building, the Planning Commission approved the conditional use permit with a condition capping height at 25 ft per city ordinance.

The full story

The Planning Commission considered a conditional‑use permit (CUP) for an oversized accessory structure proposed by James Chadwick at 4586 South 6300 West. Staff noted the request exceeded R2 zone size and height limits — the building was proposed at 3,000 square feet and a height of 26.8 feet, above the 2,500 sq ft and 25‑ft limits typically allowed in R2. The commission opened a public hearing and heard from an adjacent neighbor, Nick Smith, who asked the commission to weigh the structure’s combined size, height and massing rather than consider each metric in isolation.
