Former review-board members ask Rules Committee for a process to correct material report errors

Former ARDC review-board members urged the committee to adopt a narrowly tailored motion-to-correct to fix material mistakes in review-board reports before Supreme Court consideration, citing instances where reports misstated the record and created due-process concerns.

Mr. Eaton, who said he served on the ARDC review board for nine years and as chair in recent years, told the Rules Committee that review-board reports have on occasion contained "material mistakes in a report based upon a reading of the record," and that there is currently no clear mechanism to correct such errors before exceptions reach the Supreme Court. He described an instance in 2025 where the review board's report incorrectly described whether a continuance had been requested and granted; because the report could not be corrected under current procedures, the error persisted into the exception process.
