County asks village to clarify reduced stream setback in Naples code amendment

Jan 14, 2026

County staff and board members urged the Village of Naples and the referring board to clarify field identification of 'top-of-bank' and to reconsider reducing the stream setback from 100 to 50 feet, citing water-quality concerns and potential loss of environmental protections.

The full story

Staff introduced a text amendment from the Village of Naples proposing a change to the village code that would reduce setback protections for streams — replacing an existing 100-foot standard with a 50-foot measurement from the top of bank while narrowing exceptions to primarily public infrastructure. Staff told the board that soil-and-water reviewers had "major concerns" about the reduction and that the amended code "does not specifically specify how [top-of-bank] is to be identified in the field, who determines its location."
