Staff reported a violation at the Willow Pond/Ellerbus Road legal drain, saying a developer proceeded without a required SWIP and encroached roughly 30 feet into a legal drain; staff said the developer will restore the drain and must coordinate with floodplain/area plan commission before a SWIP will be accepted.

Staff told the board that work at the Willow Pond / Ellerbus Road property, owned by Mr. Gesselman, had encroached into a county legal drain by about 30 feet. The staff member said the developer hired a private contractor and moved forward without filing a SWIP; the developer has agreed to restore the drain area at no cost to the county.
