Commission approves code fix to restore BP3 standards for marijuana testing facilities
The commission approved a housekeeping text amendment to section 430.720 to ensure BP3-located marijuana testing facilities are governed by BP3 standards (correction of an inadvertent omission from a prior code update).

On May 5 the commission approved case 2026 TXT04, a text amendment to section 430.720 of the zoning code to correct an omission that had removed BP3 district references from the standards for marijuana testing facilities. Staff explained the 2023 amendments to accommodate statewide changes had inadvertently omitted BP3 language; the proposed amendment restores BP3 applicability so testing facilities sited in BP3 will be reviewed under BP3 standards rather than being forced to comply with IP1 rules.
