Dawson County commissioners held the second of three public hearings June 5 on an amendment to Section 133-272 of the county code of ordinances that would change how the county accepts subdivision streets and rights of way.
County Attorney Miss Davis told the board the amendment would keep core title requirements — including fee simple title, tax transfer forms and certificates of title — but would remove language that forbade acceptance if any encumbrance existed. Instead, she said, property owners would identify encumbrances and the board would decide whether a specific encumbrance prevents conveyance and acceptance of the right of way. "For instance, if there's a power line or utility line easement or something like that ... we might say that's an okay encumbrance," Davis said.
The ordinance change is procedural: it retains the need for marketable title and freedom from liens while allowing commissioners discretion when non-lien encumbrances exist. The hearing opened for public comment and, with no speakers appearing, the chairman closed the hearing. Davis said the first hearing was held before the planning commission on April 22, 2025, and the third hearing will occur at the board's voting session later the same day, June 5, 2025.
No formal vote on the ordinance was recorded at the work session; staff and the county attorney indicated the item will return to the board for final consideration at the scheduled voting session.
